Attorney Stacy Barrett of Maas and Russo recently secured a monumental not-guilty verdict on behalf of Anna Nepomuceno, a Filipina mother charged with abducting and kidnapping her own daughter in Napa County back in 2014. After an intense month-long trial, a 12-person jury acquitted Ms. Nepomuceno of all charges.
On July 25th, 2014, Ms. Nepomuceno flew to the Philippines with her youngest child, M, to visit her ill father. During this time, Nepomuceno was in the process of divorcing her then-husband, Jeremy Faust, due to Faust's alleged sexual abuse of both M and Nepomuceno's oldest daughter, Nichole. Despite having purchased round-trip tickets with a return date of August 25th, Nepomuceno's family lawyer dropped her support citing irreconcilable differences, leading a family court judge to grant full custody of M to Faust in her absence.
Nepomuceno returned to San Francisco without M on February 27th, 2015 and was arrested at the airport on charges of kidnapping for purpose of permanently depriving a parent of custody. Nepomuceno would have faced up to 13 years in state prison if convicted.
"The support shown by the Filipino community helped her case and uplifted her and my spirit," commented Attorney Barrett. She added, "I have been practicing for ten years and I can say that this was the first time I've had protesters supporting my client... I am grateful for this support and I know Anna is as well."
